Our Commitment Under the Tax Agent Services Act (TASA)

At By the Bay Tax & Accounting, we are a registered tax agent with the Tax Practitioners Board (TPB). Our work is governed by the Tax Agent Services Act 2009 (TASA) and the TPB Code of Professional Conduct. These rules are designed to protect you, the client, and ensure we meet strict standards for ethics, competence, and transparency.

Your Rights and How We Uphold Them

We believe that professional obligations should reflect the way we work every day — openly, ethically, and in your best interest. Here’s how your rights are respected in practice:

1. The right to understand what you're paying for
We do our best to communicate our services to ensure that you know:

  • What services we will provide

  • Whether it’s a once-off fee or part of a monthly retainer

  • What is included and what might be considered out of scope

How we uphold this:
We provide all clients with a detailed Terms Of Engagement. This could be by either a personalised proposal, with clearly labelled service descriptions, or for individual tax return clients, we will refer you to the list of services and fees as published on our website.

2. The right to know who is handling your information
You deserve to know who’s working on your file.

How we uphold this:
We disclose all employment, third-party and offshore arrangements in our engagement letter. Where required, we only use trusted providers and all work is supervised by us. Your data is only accessed as required required for the agreed services.

3. The right to confidentiality and data protection
Your personal and financial information is protected under law.

How we uphold this:
We use secure, cloud-based platforms with access controls. Your data is never shared without your consent, unless required by law.

4. Acting in your best interest
We’re committed to acting honestly, lawfully, and in your best interest — always. If we believe any information is incorrect or misleading, we’ll speak with you before taking further action.

5. The right to raise concerns
If you ever feel something isn’t right, you have the right to speak up.

How we uphold this:
We welcome open communication. If we can’t resolve an issue, you may lodge a complaint directly with the Tax Practitioners Board: https://www.tpb.gov.au/complaints
